Personal legal documents are those that enable you to stay in control of yourself and your assets through life and to direct final distribution of your assets after your death. The following is a list and brief description of some of the most popular documents.

 

Last Will and Testament

A will directs the distribution of property owned in your name alone, at the time of your detah. It does not control assets owned with rights of survivorship to another, trust property or assets with a designated beneficiary. A will can nominate a guardian for minor children. Every adult should have an up-to-date will made in the state of their residence.

 

Living Will

This is a written directive by you that artificial, life prolonging procedures are not to be used when your death is imminent.

 

Living Trust

A widely discussed and misunderstood document. A trust names a trustee (usually yourself initially) and directs the trustee how to use the assets you transfer to the trust. A trust can be used as an alternative way of passing your estate after your death or it can be used to provide care for a dependent person who survives you. A trust does not necessarily save taxes. We offer a personalized conference to help you decide if a trust would be suitable for you, at a modest cost. you can change a trust by amending it.

 

Power of Attorney

This is a document in which you name another person to act on your behalf if you are away or unable to act because of health reasons. It is void after your death. People over 65 years of age should have one on file with a trusted family member or firend.

 

Medical Power of Attorney

This document permits you to name a person to make decisions concerning your medical and health care issues if you become unable to make decisions or to communicate your decisions.

 

Premarital Agreement

This is an agreement, usually made by people entering a second marriage, in which each party surrenders all rights he or she might have against the estate of the other by virtue of the fact that they are married. The agreement must be signed well before the marriage. These agreements are used where the people want to keep assets separate, and perhaps to relieve their childrens anxiety about the second marriage.

 

Testamentary Trust

This is a trust that is created in your will and becomes effective upon your death. This is an ideal way to provide for minor children, granchildren or a dependent person who may survive you.
